Fanfare Competition: General Terms and Conditions of Entry

 

  1. These Terms and Conditions of Entry apply to the competition conducted by Artology Ltd. This competition is for the creation of original musical compositions (‘Fanfares’) that will be played in place of the bell cues in performing arts venues around Australia to alert audiences that a show is about to commence or recommence.
  2. By entering, entrants accept these terms. These terms may be amended or replaced from time to time. Please ensure you have read through and understood the conditions.
  3. Entry is open to Australian permanent residents aged twelve (12) to twenty one (21) years of age on the due date of entry.
  4. The competition will be conducted annually during the competition period specified on the Artology website.
  5. The entry method is as follows:
    (a) Entrants must complete the online Submission Form, the information on which are part of the Terms and Conditions of entry. The Submission Form is accessible via the following link: http://artology.org.au/?p=182
    (b) Entrants must submit an original composition that is an attention-grabbing musical fanfare notated in short score, with indications of instrumentation (within the maximum instrumentation specified below) AND a further full score, notated with full orchestration, of any four bars of music drawn from the short score. The composition should last no more than 30 seconds in duration.
    (c) The maximum instrumentation shall be: 1 flute, 1 oboe, 1 clarinet or saxophone, 1 bassoon, 2 trumpets, 2 french horns, 1 trombone, strings (8 violin I, 6 violin II, 4 viola, 3 cello, 2 bass), timpani, percussion (no more than 2 players), electronics or recorded sound. Percussion list: 2 bongos, bell tree, bass drum, castanets, snare drum, suspended cymbals (China, standard), glockenspiel, marimba, tambourine, tenor drum, triangle, tom-toms.
    (d) Entries must be received online by the due date as specified on the Artology website.
    (e) Entrants may submit only one entry.
  1. Artology accepts no responsibility for late, lost, incorrectly submitted or otherwise faulty entries. Artology accepts no responsibility for any problems or costs associated with communications networks or services. Entries via email are deemed to be received at the time of receipt by Artology and not at the time of transmission by the entrant.
  2. All entries will be acknowledged by return email to the email address provided by the entrant.
  3. A maximum of eight (8) winners shall be selected. Judging will take place at the Artology offices in Sydney, Australia.
  4. The winners of the competition will be announced on the date specified on the Artology website. The prizes will be awarded to the valid entrants who are deemed to have submitted the best entries, as determined by the Judges. Artology encourages winners to register their works with a performing rights organisation such as the Australasian Performing Rights Association (APRA) in order to receive royalties from public performances of their works by Artology and performing arts venues.
  5. Each of the eight (8) prizes are identical. Each prize comprises the following package
    (a) A sound recording of the entry made by Artology (the sound recording copyright of which vests in Artology).
    (b) Workshop and correspondence with professional composers provided by Artology in July-August or at other times determined by Artology.
    (c) Rehearsal and recording sessions with an orchestra and conductor provided by Artology in Sept-Oct or at other times determined by Artology.
    (d) On one or several occasions, public address of the recording at venues around Australia foyer played as the ‘bell cue’ for audiences to take their seats.
  1. As this competition is a game of skill, chance plays no part in determining the winners and each valid entry will be individually judged by persons nominated by Artology.
  2. (a) All entrants, including winners, retain copyright in their musical composition during the entirety of the competition. The winners grant Artology the nonexclusive rights for the world and for the legal term of copyright to use their compositions for the purposes of running and promoting the competition. Such use is noncommercial, may involve any media. Any public performance at a venue is always subject to any applicable payment of licence fees via performing rights organisation such as the APRA AMCOS. All materials submitted to Artology in connection with this competition (whether in hard copy or electronic form) may be perpetually retained or disposed of by Artology.
    (b) Artology grants each winner the nonexclusive rights, at no charge, to use Artology’s professionally-produced sound recording with orchestra and conductor of their respective work in any noncommercial promotional way that the winner sees fit, for the world and for the legal term of copyright. Any commercial use of the recording by a winner is subject to separate agreement with Artology.
    (c) Unless the winner is a resident of the city in which an event takes place, Artology will organise and pay for travel expenses of each winner to an event in the competition, such as workshops, recordings and media appearances. If, at Artology’s discretion, a winner is required to be present at a performance, Artology will organise and pay for the winner’s travel expenses. Also at Artology’s discretion, Artology may also organise and pay for a parent or guardian to accompany the winner.
    (d) At Artology’s discretion, Artology may elect to conduct workshops led by its professional mentor composers for the benefit and development of non-winners.
  1. Each entry must be the entrant’s original work. By entering this competition, entrants undertake to Artology that their entry is not, and its use by Artology will not be, in breach of any third party intellectual property rights.
  2. Entries that, in Artology’s judgment, are offensive, defamatory or otherwise objectionable or inappropriate or that infringe any third party rights will be invalid.
  3. The Judges’ decisions are final and no correspondence will be entered into.
  4. Where a prize involves the winner attending an event such as a workshop, if any part of the event is abandoned, called off, varied or postponed for any reason, then at Artology’s discretion, the relevant winner forfeits all rights to attend the relevant event and no cash or alternative events will be substituted for that element of the prize.
  5. Artology may, at its discretion, require any person under the age of 18 taking a prize to be accompanied by a parent or legal guardian while taking the prize.
  6. At Artology’s request with reasonable notice, winners agree to participate in all promotional activity (such as publicity and photography) surrounding this competition or the winning of any prize, and they consent to Artology using their name and image in promotional material. Winners consent to being broadcast, filmed, photographed or otherwise recorded while participating in this competition and in taking or using any prize, and they consent to Artology using the broadcast, film or other recording to run and promote the competition.
  7. If an entrant is unable to or refuses or fails to take part in any element of this competition or a winning entry is deemed not to comply with these terms, Artology reserves the right to discard that entrant’s entry and proceed as if that entrant had not entered the competition.
  8. The winner will be notified by email to the nominated email address provided by the entrant. If required by law or other relevant authority, Artology may publish the name and state of residence of the winners. Artology will not publish the full address of any entrant.
  9. The winners will be notified by telephone and email and must accept the prize in writing by email reply to Artology within two working days of being notified of their winning entry.
  10. If a prize is not claimed by the entrant, Artology reserves the right to distribute the relevant prize by awarding the relevant prize to the next best valid entry as considered by its judges.
  11. If requested by Artology, any entrant or winner (or if an entrant or winner is not an adult, their parent or guardian) must sign an indemnity and exclusion of liability form (provided by Artology) in favour of all parties involved in this competition and/or providing the prize prior to undertaking any specified activities forming part of the competition or prize. If any entrant, winner, nominated companion/s or parent/guardian (if applicable) do not sign the indemnity form provided by Artology within the time requested by Artology, the entrant’s or winner’s entry or claim will be deemed invalid. Where a winner’s entry or claim is deemed invalid, Artology reserves the right to determine a new winner.
  12. Since Artology works with performing arts venues across the country, prizes and participation in this competition may become subject to further conditions imposed by these venues and Artology, and Artology will notify winners of these from time to time.
  13. Artology and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  14. Artology may require any winner to provide identification as requested by Artology including (without limitation) proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at Artology’s discretion and may include suitable photo identification.
  15. If due to any reason whatsoever Artology becomes aware after an entrant has won a prize that the entrant has not complied with these terms, that entrant will have no entitlement to the prize, even if Artology has announced them as a winner and that entrant will be required, at the direction of Artology, to return or otherwise make restitution of the prize.
  16. Artology may, in its sole discretion, disqualify any or all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these terms, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
  17. No prize is transferable or exchangeable, nor can it be redeemed for cash. In the event for any reason a winner does not take an element of any prize at the time stipulated by Artology then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. Artology accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason, Artology may substitute for that prize another item of equal or higher value as determined by Artology, subject to the approval of the relevant authorities in the relevant state, if required.
  18. Without limiting Clause 26, Artology and its associated agencies and companies make no warranties or representations about the fitness for purpose or suitability of any prize and will not accept responsibility for the quality or fitness for any purpose of any prize, or the failure of any prize to be of any perceived quality.
  19. If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, telephone network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of Artology, Artology may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the relevant authorities in the relevant state, if required.
  20. Without limiting any other paragraph, Artology may at its discretion amend any aspect of this competition or of these terms, subject to applicable laws and subject to the approval of the relevant authorities in the relevant state, if required.
  21. Artology accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
  22. Each entrant must ensure that any other person whose details have been provided by the entrant to Artology for the purposes of the entrant’s participation in this competition has given their implied or express consent for their details to be provided to Artology and its associated agencies and companies in relation to this competition.
  23. The information entrants provide will be used by Artology for the purpose of conducting this competition. By entering this competition, entrants consent to the storage of their personal information on the databases of Artology and its associated agencies and companies and its related bodies corporate and Artology and its associated agencies and companies may use this information for future promotional and marketing purposes regarding their products and services including contacting entrants via electronic messaging. Artology may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. Artology is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information Artology and its associated agencies and companies hold about them by contacting Artology.
  24. Past winning entrants can only re-enter the competition after two years (ie. if your Fanfare composition won in 2015 you can enter the competition again in 2017).
